Legal Question in Personal Injury in New York

I had 2 vehicles and one of them was insured and registered and one was not insured but registered. The one that was not insured was parked in my driveway not being driven. I went to work one day and My husband at the time took the car knowing that it was not insured and drove it without my permission. Well he got into an accident by hitting a utility pole with no one else involved. He got ticketed for it, but I got the judgement against me for a lot of money. I was not involved at all and had no part in this and never gave permission to use it. In the judgement someone said they served me and they never did and then filled out the description of me thats was totally wrong. How do I get this removed from my credit and my name and he gets nothing against him. This is ruining m credit and life. Please advise on what to do.

You need to retain an attorney to make a motion to the court to vacate the default judgment against you for lack of personal jurisdiction and other defenses you have to the judgment entered against you including the lack of permisssion to drive the vehicle and to join your husband as a party to any future action. This may cost you more than ultimately satisfying the judgment with help from your husband.
