Legal Question in Personal Injury in New York

Auto accident claim

Hi I got into an accident today with my 11 month daughter, at first I felt ok, but now I am getting some sharp pains in my lower back and my right elbow, My daughter does not live with me, but about an hour or so after i took her home to mommy, she called me up and said that it seems like her right foot pointing inwards, so she took her to the emergency room, i need advice on what to do concerning, reimbursement for my medical bills and anything else.

Re: Auto accident claim

If you were driving or in a car, you must notify the insurance carrier for that car that you and she had an injury and that you need a no fault application. You must fill that out and send it to the carrier no later than 30 days after the accident. You must notify medical providers of the no fault coverage and make sure they have claim number and address etc so they can get their bills in w/i 30 days after service.

Re: Auto accident claim

The insuranc lobby has just had the regulations changes to shorten to 30 (thirty) days the time to let the insurance company knw of the accident and to FILE for benefits. Call your insurance company immediately for the No-Fault forms.

Good Luck

Re: Auto accident claim

There is a new 30 day rule where you are required to notify insurance company if you were driving a car so no fault will cover it for you. You may also want to set up a consultation with an attorney to get more in-depth counseling.
