Legal Question in Personal Injury in New York

Auto accident, traffic light malfunction.

I had an auto accident in Glen Cove N.Y in early

June 1999 due to a traffic light that

malfunctioned.The car coming acros the

intersection had a green light and so did I. This

is in the police report and there were

eyewitnesses. My out of pocket expenses were

$2800.00 for rental car, and doctor bills, and

lost wages..due to severe whiplash. This was filed

as a "no-fault" through my insurance company, but

I was under the impression that I would be

compensated through them for my lost wages, but

was just informed that that would be only $100 per

week that I lost work. I would like to sue the

Town of Glen Cove now. my question is...Is it too

lat?? ahas too much time gone by?? should I file a

claim on my own in small claims court, or should I

get and attorney, and go to court for a larger

suit?? for pain

You may have or had a viable claim agaisnt the town or county. However, in order to sue a muncipality, a notice of claim must be timely filed, usually within 90 days of the accident.

I suggest you consult an attorney to explore your rights.
