Car accident in a taxi

hi i was recently in a car accident as a

passenger in a taxi ...my boyfriend and i

were traveling to work when our taxi

was side swiped by another car...we

unfortunately do not have the cab

drivers license and no police were called

however my boyfriend took pictures of

both vehicles with me inside the taxi

and the cabs logo on it...we also got the

drivers name and number of the car and

we agreed to call the driver the next day

to get all the other info ...my boyfriend

was carrying something that was heavy

in his lap and his neck was jerked pretty

bad he has been getting some neck

pains after the fact...we would like to

know the best route to take for seeking

any kind of action against the cab

company who does not want to

cooperate with us and handing us the

proper information

For the most part, there isn't any money in soft tissue cases such as this, particular in the event of a sideswipe that resulted in minimal damage to the vehicle and for which there is no accident report. No-fault law requires a "serious injury" to recover for pain and suffering, and the threshold for meeting the "serious injury" requirement is rather high. You can file a no-fault claim with the taxi cab you were in to cover the cost of your medical bills. Good luck!

We have handled a great number of soft tissue cases and have been able to settle most of them. If your boyfriend has been hurt and is experiencing pain, he needs to see a doctor right away, he may have suffered a more serious injury than first realized. If you have plate numbers for the vehicles involved, we could run the plate numbers and get appropriate information to proceed with the no-fault claim and if warranted, for a subsequent claim for pain and suffering. With the taxi's number (I assume you mean the medallion number) you can get most of the information you need from the Taxi & Limousine Commission. You need to file a no-fault application within 30 days of the accident with the cab's insurance company. If your boyfriend (or any family he lives with) has a car, he should put them on notice of the accident as well. Your boyfriend needs to treat with an orthopedist to see if he has an injury that will permit a lawsuit or settlement. He will need to have an MRI in the areas that hurt to determine the injury.
