Legal Question in Personal Injury in New York

children's health concerns

I live in a condo (3rd floor or 3 story building) and my downstairs neighbor smokes marijuana 3-5 times a week. The condo board had offered to ''send a letter'' since they are limited in what their involvement could extend. I have 2 young children; 3 1/2 years old, and 10 months. Their well being is my priority and I'm afraid their health is at risk. The stench is unbearable and I am at a loss for options.

Please advise.

The condo board bears the responsibility to oversee the safety and security of all tenants. Ask the board to send a letter to the neighbor and get a copy for your records. The board should have written rules and procedures as to how to handle drug use problems, they should be able to initiate removal proceedings. Another alternative is for you to call the police, but make sure that you call when your neighbor is smoking. Be careful, depending on circumstances, it may be better for you to find another place to live.
