Cracked tooth on piece of popcorn

Hello,

I fractured a tooth on a piece of on poped popcorn at a movie therater in NY. It is going to cost me thousands of dollars in dental costs. Do I have a valid claim to recoup my medical costs?

One might argue that when you eat popcorn, you are assuming the risk of biting down on unpopped kernels, which certainly are known to cause tooth damage.

On the other hand, insurance companies for restaurants routinely pay out claims for similar claims. Feel free to contact my office via email for a complimentary consultation.
