Legal Question in Personal Injury in New York

Dog hit by car

Ive repeatedly asked our carpenter (who is renovating our kitchen) to keep our gate closed as we have a number of cats and dogs in the house. Our animals have got out a few times. Then we were dogsitting for friends. The very next day the carpenter left the gate open, and one of the dogs we were sitting was hit by a car (Hit and run) The dogs hip was broken and so far it has cost us over 10,000$ In hospital bills and rehabilitation. The carpenter claims he isnt liable. My question is that can i hold him responsible, and will his insurance cover something like that.

If he has insurance, it should cover his negligence for leaving the gate open.
