Legal Question in Personal Injury in New York

Estimate of Damages

I was in a store on a Sunday. They had been ripping up thin layers of tiles earlier in the week. I caught my heel and fell backwards injurying my foot, hip, & neck. There were no warnings about the tile removal. (I have pictures of the scene of the accident.) I have been undergoing physical therapy. (I filled out a report and was told I would be called by the corporate offices within one week. That was 10 days ago.)

Although I'm suffering, I'm sure in time and w/ physical therapy, I will be fine. Because there are not life-long injuries, may I still claim for my medical bills as well as pain and suffering? If so, how do I determine a dollar amount?

You can and should file a claim or lawsuit against the store owners. Don't minimize your injuries, as soft tissue injuries can cause more long lasting problems than broken bones. At minimum, you are entitled to be compensated for medical bills, transportation to and from medical appointments, lost wages, if any.

You may be entitled to a recovery but this is an art and not a science...That is why you need an attorney..insurance companies WILL low-ball you.
