Legal Question in Personal Injury in New York

Eye injury

When I was little I went to the local gardening shop with my mother. I was playing with some other kids with some sticks. I tripped down some stairs and the stick went into my eye. I remember it hurt like hell and I had to have lots of surgery. For a while after that I had to wear a patch over my eye. I wanted to know if I could sue the garden outlet. I don't know if my mother already did though. If she did would she be responsible for the money back to me. Thank You for your time.

Your question raises several issues. (1) How old are you currently? Depending on your age and how long ago this occurred, the Statute of Limitations may have already run and it may be too late to file any claim. (2) What did you originally trip over causing you to fall and causing the stick to go in your eye? You must show that the store had a dangerous condition which caused you to fall...

If your mother has already brought a suit on your behalf, the law requires that any money that resulted in the recovery be put in a trust account in a Savings Bank for your benefit until you turn 18, at which point you're entitled to access the money.
