Legal Question in Personal Injury in New York

Fleeing Scene

I have a young friend who was in an auto accident last year (he & driver hit a parked city truck). The driver panicked, removed the plates from the vehicle (his dad's)and they both left the scene. The driver's dad reported the vehicle stolen. Now, 1 year later, my friend (he has lost contact with the driver) claims to have back & shoulder pains. Can he go after the driver for damages?

You have 3 years to sue for personal injury.

Since the accident was never reported and your young friend has had no medical treatment for 1 year.....how are you going to prove your case?

Also, does the driver have any assets as the insurance co most likely will not cover this untimely claim.

If he can find him he can try, but the insurer will deny both the no fault and coverage for the liability action if it uwas not reported in a timely manner.
