Legal Question in Personal Injury in New York

GL Med Pay provision - NY case

minor fell in playground broke elbow. Parent with child, so no liability on the part of our insured. minor/clmt has not come forth to present a claim, however, recieved a lein letter. Question: do I owe this lein provider payment of med bills, if the injured party did not present a claim, and is our policy excess or primary.. thanks
