Legal Question in Personal Injury in New York

I was hit by a car while crossing the street. A police report was done and it appears that the driver was unlicensed and was not the owner of the car. Upon contacting the insurance company 1 week later I discovered that no claim was made. I was taken to the hospital by ambulance and had a series of tests, xrays etc. What are my rights for medical bills etc.
