Legal Question in Personal Injury in New York

Insurance denies my claim

The insurance company(my father's insurance;I was the driver) sends me to 3 doctors within a 45 minute period and they all state that I can return to work(lies).Last week I just had an L5-S1 disk decompression with spinal fusion and instrumentation because of said accident.They have yet to take a look at my neck.

My personal injury attorney tells me that I should wait to go to arbitration once the case is almost settled,so I have the TOTAL figure to bring to the table.

What are my options?

The question doesn't quite make sense. It sounds as though you are mixing apples and oranges, or "no fault" with a personal injury action. Your mention of arbitration is also ambiguous; it could refer either to a no-fault arbitration arising from the denial of medical bills (more then likely)- but then you mention your PI attorney and his recommendation.

You will have the total figure from doctor and no-fault whenever you go to to no-fault arbitration; if you have doctors who have different opinions about your work capability arbitrate that. You need to explain the question more clearly.

Until you know the extent of your damages it does not make sense to settle your claim, once you settle your claim you cannot renew it if you incur further damages in the future.
