Is a sub-lessee liable for a personal injury sustained in a common area of a commerical building when the landlord was responsible for maintenance of the common area?

Re: Liability of Sub-lessee

You must look to the lease agreement.

Generally, if the claimant slips in the demised area, the lessee will be sued, as may the lessor.

The lessee in turn,if the lessor is not sued directly, based on the lease and/or common area control, may sue the lessor.

The situation is very fact dependant.

Good Luck.
