It depends. If you cane get jurisdiction over the defendant you can sue here and use a NY lawyer. Also, a NY lawyer can try and reach a settlement and can refer the case to a SC attorney. Feel free to contact me as I work with attorneys in other states.

Finding local counsel is always a good idea. Not only would a South Carolina attorney be familiar with any specific "locale" law issues, he or she would often know the judges and local defense counsel. On the other hand, depending on the type of injury there are many New York attorneys who may be willing or have an ability to handle cases in other jurisdictions.

Whether you need a SC attorney or a New York attorney depends on certain facts of the case. Conflict of laws statutes are complicated. One way to gain jurisdiction here enabling you to use a New York attorney is if the defendant has substantial contacts with New York. If we can prove that then we may be able to obtain jurisdiction over the defendant in New York thereby allowing a NY attorney the right to represent you here.

Another possibility is to have a New York attorney attempt to settle the case for your here in New York and, if unable to do so, may refer the case to local counsel in SC if he is unable to settle the claim before the statute of limitations expires.
