Legal Question in Personal Injury in New York

If someone has a party and one of the guest leaves and hits a car and drives away and it is not known who hit the car who has to pay for the damages?

Without seeing the policies and knowing more (besides-nice friend) I cannot answer for sure. The guest with the car should be able to claim under his SUM coverage (I pay extra for both supplemental SUM uninsured motorists coverage) the same way as if he was parked on the road and someone hit and ran his car. They may try to make your homeowner's policy cover it. I predict the two insurers will fight it out.
