Legal Question in Personal Injury in New York

pedestrians hit by car

a woman and her 2 years old daughter were crossing in the middle of the street, due to a truck blocking traffic. there was a car double parked when the woman & child crossed the driver proceeded to back up knocking the child down and hitting the mother. the mother banged on the car for the driver to stop. the driver gets out and asked them if their okay. no one witnessed the incident just them three. the driver drove off before any police could arrive, however the mother didn't want to upset her child and went home. the mother began to feel pain in her lower back, hip, thigh, and numbness in two toes,so she went to the hopital the next morning. does she have a case against the driver with out having a police report and what can she sue for.

The woman and her child can sue for personal injuries received, and pain and suffering. How much they could sue for would depend on their injuries, and whether there will be substantial and lingering effects of the accident.

From your posting, I cannot tell if you are the person who was hit, or the driver. If you are either, you should contact an attorney immediately. If you are a concerned friend, you should tell the people involved to consult an attorney immediately. There may be others who should be sued in this situation, such as the municipality, but this must be done very quickly.
