Legal Question in Personal Injury in New York

Question on a Automobile Accident

Dear to whom it may regard:

I have a legal question concerning a civil case and would like to seek some simple advice. Five years ago, in 1995, my family and I were in a big accident on an interstate highway which consisted of four cars in a collision. The accident occurred do to a careless female driver skidding across of an interstate lane and creating a chain reaction of crashes. We have hired a lawyer and are suing the defendant on 6 counts of actions. We have already had a deposition two years after the accident, and are currently awaiting a physical examination by the defendants doctors. Is this physical examination a legal procedure or process that has to occur before court can proceed? The reason I am asking for help is because we are currently living in a different state and communication with the lawyer is very isolated. The lawyer does not mail the information I have requested, and does not update or call either. I am feeling very dumbfounded and illiterate by his attitude ,and want to know if he's doing a good job and if these legal procedures are correct. Plese e-mail me ASAP and some good solid advice on these matters.

It is not unusual to be examined by a defendant's doctor but the real issue here is the poor communication with your lawyer. You have every right to be kept fully informed on your case including copies of EVERY thing that is done if you desire. Remember, the lawyer works for you! If he will not communicate to your satisfaction then you have the right to seek other counsel. You will need to decide whether poor "bed-side manners" are offset by any special skills that the lawyer may have for your particular case.You might express your concerns and ask for an explanation on why your requests are not being honored.
