Legal Question in Personal Injury in New York

I rent an apartment in Scotia NY and I slipped and fell on ice that was not salted or sanded by the landlord. I sustained a slash in my head that I went to the emergency room for, I recieved stitches and lost a day of work. The insurance company offerd me $3500, how much is a head injury worth? I am 65 and feel the landlord should take better care of the driveway.

How much the case is worth depends on how stong the liability is and what the injury is. If its a simple cut with a few stiches and no scarring the offer might be fair. If you hit your head, you may have a more serious injury and the case may be worth more. Once you settle, you can never get more. Thus, it is advisible to wait for a period of time following and injury to settle.

I am very sorry for your ordeal. The value of your case depends on the extent of your injuries and whether you can prove liability (who is at fault). Slip and fall cases involving ice depends on whether the landlord or company responsible for removing the ice and putting sand or salt had notice of the ice and had a reasonable amount of time to sand, salt or remove the condition. The extent of your injuries may not be fully realized if the accident happened recently. I would wait and go through all your treatment. Once you get a diagnosis and prognosis from your doctors we will be able to decide the true value of your case. The worst thing you can do is settle the case quickly and then find out months later that you have a more severe injury than you realized. Thank you for your inquiry.

Unfortunately our office does not handle cases in the Albany area.

Moreover, I would need to meet with you personally and review your medical records to make a recommendation regarding a reasonable settlement.

I would recommend contacting the Albany County Bar Association. They should have an attorney referral program and be able to recommend a reputable and skillful attorney that can assist you in evaluating your potential case.

I wish you well in your pursuit of Justice.
