Legal Question in Personal Injury in New York

School puts child in severe danger

My 14 year old son was told by the high school monitor to leave the school premises when he could not produce a student ID he has yet to be issued( we just moved to this area), forcing him to walk 13 miles to get home, in severe weather conditions( subzero and windy) with no hat, boots or gloves, most of the time walking along a highway. What recourse do we have?

Re: School puts child in severe danger

Please call a lawyer in your area. I am outside the USA and cannot assist you directly. You will have to prove your case and under NY law even if you do not owe an attorney fee until the outcome of the case, you are still liable for all the expenses of the case. You must weigh the harm done, the costs involved in pursuing the claim and all other factors. I wish you the best of luck in making your decision and following up on it. There are also very short time limits, a very short statute of limitations, which may apply to you bringing a claim and preventing one if you delay, so I urge you to act immediately.
