Legal Question in Personal Injury in New York

My nine year old daughter fell off a new-style-swing in a playground. Her neck got caught in the retainer as it unbuckled while she was swinging. She was rushed to ER at the nearest hospital. It was really scary. Her strength and long legs saved her life. She has a bruised neck, but thank God she's ok. Can I still sue this stupid park??? How can they have something so unsafe? I'm lucky that it wasn't my 4 year old son who was swinging next to her. He would have suffered more injuries. Im worried ab other children.
