Legal Question in Real Estate Law in New York

Agency will not release my files

I am a realtor and changed association to another firm reecently. I went to collect my customer and personal files and was told that they belong to the agency even though most if not all files were my files from a previous association. They release only my continuing education files. What rights do I havde to my work product?

The answer to your question depends on whether or not you were an employee or independent contractor of the firm you left. As an employee, your work product would remain the property of that firm.

Many realtors are simply Independent Contractors. I would advise you to review any paperwork you completed with said firm to determine the agreements made by each of you prior to commencing the relationship.
