Agent forged my signature on Binder

I agreed to a price of 555K to sell my home. The buyer's agent wrote a sales binder for 550K, forged my signature on it and sent it to my (seller's) agent. My agent then sent the binder directly to my lawyer. My lawyer saw a signed binder and issued a contract for 550K. When I saw the contract and binder I of coursed refused to sign. The lawyer says because he issued the contract, he is keeping my $400 deposit for legal fees. I'm out $400.

I'm located in NYC. I imagine I can take both agents to small claims court to recover my $400, but I was hoping someone could offer me some more advice at best action. Forging someone's signature has got to be a major crime.

Forgery is a crime.

A RE Agent in Rockland County was recently arrested for forging her Seller's signature on a RE form.

Why would you take BOTH agents to court? Was the other one aware of the forgery?

Tell your agent you are giving her 1 chance to re-imburse you or you will be filing a complaint against her with the DOS (or police?).
