Legal Question in Real Estate Law in New York

I had brand new carpets installed on 11/19 then on 11/20 I had a new bedroom set delivered by Taft furniture. The bottom of the dressers had varnish on them that stained my 1 day old carpets. Stanley steamer tried to remove the stains and they will not come out, now the furniture company wants to have another carpet cleaning company to try again. I want my carpets replaced...they were brand new and even if they stains come out now (which I doubt they will) I want new carpets, not carpets that had to be cleaned two times in 2 weeks. What is my legal rights? If the carpets are less than 3o days old and now they are altered, I feel the furniture company should be responsible to replace with new carpet...not just try to clean them

Your best chance here will be to file an insurance claim (under your homeowner's policy). It will be a long time before you see a penny from the furniture company.
