Legal Question in Real Estate Law in New York

I have a contract to purchase an apt in NYC signed and with 10% in escrow since 11/11/12 with a closing date on or about 30 days. Its well beyond that. I have sold my apt and am essentially renting it from the new owner who wants me out is 14 days. My attorney sent a "time of essence letter". I found a great rental. Can I get my 10% back since they don't appear to want to actually go to close?
