Legal Question in Real Estate Law in New York

eviction after foreclosure sale

Our home was bought back by mortgage company at auction. What is the law for them to get us out? How much time do we have? We were offered an amount to vacate but given less than 3 weeks to go. Should I wait to be evicted/

Re: eviction after foreclosure sale

You traditionally have 30 days to recover he property after a foreclosure sale. If not redeemed, the party acquiring the property can start suit for eviction. This may take a few weeks to get on a court calendar. If no arrangements are made for a "rent" payment by you, the Court will order immediate eviction. All you do is buy some time, but get nothing. If they offered you some money to get out, you should consider taking it and moving.
