If the Will is capable of being probated, it should be probated and it will start to resolve the problem. I anticipate that the probate will be contested and the questions involved will require Court hearings and a determination. This conclusion is based upon the simple facts presented and more facts are needed for a complete response, since additional and/or different facts could change the response. This is a response to an Internet question and the reply is based solely on the facts presented, and if additional facts were presented they could change the conclusion. The response is not intended to be legal advice or as creating an attorney-client relationship.

The Will needs to be examined to see if it meets the requirements for probate.
