Legal Question in Real Estate Law in New York

I live in NY and my ex has one of my dogs that I had long before I met her. She refuses to give him back. How do I go about getting my dog back cause I don't want a civil suit cause they told me at the court that I'd only get the monetary value of my dog if I did it that way. That's not what I want cause u can't put a monetary value on the bond between me and my dog. I wanna kno what I havta do to get my dog back. I don't want money for him I want my dog. The police won't do anything for me they told me I havta get a bill of sale from the breeder even tho I didn't buy him from the breeder directly. One of my friends bought two dogs not knowing if they wanted a male or female and when they decided which they wanted I bought the other from them and have the bill of sale from the person I bought him from. My ex even kicked in my door the other day to get what lil bit of clothes an stuff she had left in my apt and the police hadta come to remove her from the premises and there was a domestic report filed over it where she was the suspect but yet they still won't do anything to help me get my property she had of mine and my dog back. All I want is what's mine back from her and that includes my dog what do I havta do to get him back an not money for him cause the bond me and my dog have is priceless.

Unfortunately, our laws have not, for the most part, sufficiently advanced from considering pets as goods or chattel.

Still, there is a remedy for you. You would have to bring an action in New York State Supreme Court in which you seek "replevin" (the return of an item) and/or an injunction.

I recommend that you promptly consult with an attorney. If you would like to contact me, I would be pleased to help. I can be contacted at [email protected] or (212) 791-6240. Of course, you can consult with any other attorney of your choosing.

Good luck to you.
