Legal Question in Real Estate Law in New York

Neighbor selling house to a group home

My neighbor is selling his house to a group home for handicapped and rehabiltating adults in my neighborhood. It is a nice neighborhood with a lot of little children. I am worried because I have kids and I am worried that by putting a group home in the middle of a neighborhood with a bunch of handicap and rehabilitating adults walking around. Not to mention that nurses will be coming and going and there really is not enough parking in the area to handle this. What legal rights do I have as a homeowner to put a stop to this. Also the property value in the neighborhood will probably go down. I know this sounds like I am being pompous but a value verything for my children and I am afraid that is this group home comes in that my kids might be in danger. Please let me know what I can do? If I can do anything.

Re: Neighbor selling house to a group home

Check with your local town/village hall (building or planning department). A variance might be needed in which case there will be a public hearing, unless as of right it may go in as already zoned.

Good Luck

Re: Neighbor selling house to a group home

If you cannot block the issuance of a permit/variance for the home (if one is needed) then consider getting together with you neighbors and buying the home. You can always turn around and put it back on the market and the property values in the neighborhood will not be affected.
