what is the legal difference between an occupant of an apartment (with a lease) and a guest?

One is a Tenant with rights spelled out under the lease. A guest must keave when you ask him to.

Occupant (tenant) is the one who has the rights to use and occupancy as permitted by the lease. A guest is a temporary situation at the will of the occupant and would include an invitee, friend, workman or anyone whose use and occupancy has been granted by the occupant-tenant. Whether or not the guest has any rights against the landlord (such as being able to hold the landlord responsible for an injury) is also subject to the terms of the lease.
