Legal Question in Real Estate Law in New York

I am an ownder of a newly constructed condominium. After moving in several months, I noticed beetle holes on the floor. I informed the seller (I have a one year warranty with him) and he agreed to treat the floor for me. However, he does not want to pay for the related expenses such as moving and living costs. I am wondering if I can hold him liable on the cost in this case.

It would depend on the language in the warranty. However, generally the answer would be no.
