Legal Question in Real Estate Law in New York

partition sale in a co-op

Is it possible to do a partition sale in a co-op apartment building? And if so, how do you get the uninterested seller to leave if she currently resides there?

Re: partition sale in a co-op

If you are talking about splitting up the interest in the shares, this might be allowed, although parition may not be the appropriate proceeding. You will also have to check the by-laws to see if this is a prohibited action.
