Legal Question in Real Estate Law in New York

Can't get people off my land please help me!

I bought a piece of land from my Grandmother in Oct.,2001. My Aunt and her husband (soon to be ex) own the land in front of mine. His son lives on my land, he put in the septic system and put money into the land. My Grandmother has always owned it and never gave him permission to do anything to the land. I sent him an eviction letter in Dec. asking him to move his trailer off the land by March 1, 2002. He will not leave, he's filling the septic system with rocks and damaging the property. He says I owe him $3000. because thats what he put in the land and he won't leave until I give it to him. Please help me!! What can I do? I'm a single Mom staying with my parents because I can't live on my own land. Thanks.

I'm afraid that the only thing you can do is get a lawyer to start an action to throw him off the land and stop doing work on it. Since he is not simply a tenant, you would have to evict him in court. Before then, call the police to get him off your land, altho they probably will just tell you to go to court since the ownership may be in dispute. Good luck.
