Legal Question in Real Estate Law in New York

Property Damage

My car was damaged while parked in the middle of the night. A woman hit the car double parked next to mine; in the effect 4 cars are damaged including the one which made the accident.

I didnt have a full insurance, the insurance that she has in property damage is only 10000, and total damages to all cars are 25000. Insurance offers me only 3K, my lost was 7,5K

How can I sue her, what should I do? I had to sell the car because I wasnt able to afford fixing it. I lost a lot of money.

Re: Property Damage

You can sue for the difference in small claims court. You have to file in the County where the defendant lives. Information concerning small claims court can be received at the Court Clerk.

During the hearing you should be prepared with either a paid receipt, or two original estimates (at a minimum).

Mike.
