Legal Question in Real Estate Law in New York

Real Estate/Basement Apt.

My grandparents will be moving into my parents new home but they are not going to sell their current home. Their current home is a 5 family. Is it illegal to make the basement an apartment for myself since no rent is being collected?

If the basement apartment can be legalized and the Certificate fo Occupancy (C of O) upraded you can occupy the apartment.

Illegal is illegal, especially in a multiple dwelling. Rent is not the issue.
