Legal Question in Real Estate Law in New York

I just received a notice of petition on my door from my landlord asking for payment that is above what I own in rent. I am currently two months behind. He is asking well above that amount. He does not have a signed lease from me so at this point we are in a month-to-month arrangement. Does he have a right to take me to court? I read that he must give 30 days notice in NYC if he wants to evict me.

How should I proceed? The notice is dated November 3rd but I only received it yesterday (November 10).

Thirty days if he wants to terminate your lease, but its only 5 days if hes claiming your failure to pay rent. He is not seeking to evict you unless you fail to pay.
