Legal Question in Real Estate Law in New York

Unable to find exhusband

I am unable to locate my exhusband. In the divorce papers I had sole occupancy/use of the marital residence with the stipulation that I had to sell the house when our youngest graduates from high school, (which is this year - 2006).

I have sent a letter to his last known address, and did not receive a reply. I would like to put the house on the market ASAP...What can I do?

Thank you.

What does your attorney for the sale say. Cheeck with that person first.

Re: Unable to find exhusband

If both of you are on the deed, then you should find your husband and get his approval for the sale. If the divorce papers provided for a transfer of his interest, then you can go ahead and sell it. Of course, an inspection of both those documents will be necessary in order to provide you with a definite answer.

Feel free to contact me if you would like me to review those items and provide you with my advice.

If your husband's cooperation/signature is necessary, then you will have to make an application to obtain a sherifff's deed - deeding the property to you so that you could sell it.
