Legal Question in Real Estate Law in New York

My wife and I put in an offer on a house and after some back and forth she agrees to accept. She did sign the contract offer. Now two days later we hear that she is backing out to wait for another offer. Is there anything we can do?

If she returned the signed offer to you or the broker, or if the down payment has been cashed, you can sue to enforce the contract. If not, then your sole remedy is to cancel your offer and stop payment on the down payment. Make sure you cancel the offer; otherwise, she could come back at any time and force you to buy. That would not be good: don't buy your home from a crook, you'll regret it eventually. And this could interfere with buying a different house (unless you can buy two houses).
