Legal Question in Sexual Harassment in New York

about agreement between tow parties

My and my boyfriend made some private pictures/movie clips. Now he blackmails money for the gifts he bought me while we were together. We agreed that I pay him certain amount(which I did)and we signed an agreement that I don't ow him anything and that he is responsible for deleting/destroying all the private stuff. The problem is that his year of birth is one year different than on the paper he signed. Is that an issue if he really won't keep his word. He is threatening me and sending emails every single day.

I would advise you to contact the police and seek an Order of Protection to stop the harrassment.

Without knowing more, the minor defect on the agreement should not render it invalid if both parties intended to be bound by it.

1. An illegal contract, or an agreement to do something illegal, is unenforcable.

2. If he made gifts to you because you were his girlfriend the gifts are yours to keep. The "agreement" should not have anything to do with it.

3. If the "gifts" were actually payments, the nature of the contract,whether it is illegal, will govern.

4. I doubt that the year of birth being off by one will cause much trouble.
