Legal Question in Sexual Harassment in New York

Harassed at work, reported it - move to another location, or resign

i'm a female paramedic and i've been sexually harassed at my workplace for a few months and recently reported it to my boss. I met with him today and he said he's talked to the male that's been harassing me and he has been disciplined, and that my choices are - move to another station, or voluntarily resign. I don't think this is fair and I feel like I'm being punished... What should I do?

Based on your facts, if moving you to another station is a demotion, than you would be suffering an adverse impact on your employment which would be actionable. Obviously, resigning would also adversely affect you, but doing so would not enable you to claim retaliatory treatment.

Feel free to contact me should you wish to discuss this further.

Kind regards,

You are quite right; their response is unfair. Please call for a free phone consult to discuss your options.

You may report this to the Division of Human Rights,( or the Commission in NYC) if you feel you are being retaliated against for reporting a violation of your rights. If the situation has been brought under control by the employee being disciplined, why is your employer asking/telling you to move?

I would be happy to discuss this with you if you wish.

Does he believe that with you present it will continue to happen?
