Legal Question in Social Security Law in New York

VA and SS Administrative

In 2002 I was forced to leave my federal position and was placed on disability from the Fed Govt. I also WON my VA appeal and recived 100% Total and permanent disabilty. I applied for and of course was denied SS Benefits. It has been over 4 years and my condition has degraded. My question is at this stage do i need an attorney or should i re-apply for SS benefits.

you absolutely should be represented. Claimants who are represented have a far greater success percentage. Also, your attorney will deal with reopening your past claim, if that is possible.

However, if you were denied because, as a Federal employee some or all of your earnings are not covered under Social Secuirty that won't change unless you have continued working. Basically, you need to speak to an attorney; there are too many issues to determine just from this question

You should file immediately because if less than 4 years has expired you can make a motion to reopen your past application and possibly collect those retroactive benefits.

An attorney is not required, but is strongly advised.
