accident liability

If i was driving a friends car and someone hit us from behind who is liabal for the damage, and who is responsible for possibly hiring a laywer me or the owner?

Generally speaking, the person driving the car that was behind is responsible for the accident. However, the owner of the car that you were driving should notify his/her insurance company. If the other driver sues you, the insurance company will provide you with a lawyer at its expense. If you were injured in the accident, you will have to retain your own lawyer. The insurance company of the car that you were driving is obligated to provide you a defense and indemnification...because the insurance runs with the car, not the driver. Be certain that the insurance company is notified or knows about it otherwise it may disclaim coverage. Also, in the event that you get sued, be reminded that you should turn the summons and complaint over to the owner's insurance company immediately.
