Legal Question in Traffic Law in New York

Age requirements to go alone to court

I recently was tried at the New York State Traffic Violations Office where they hold their Hearings. I was later informed by a friend that you have to be 18 for them to try you without a legal guardian present with you. I was wondering if that was true. I was also wondering if that gives me grounds to appeal my case.

Re: Age requirements to go alone to court

Yes. This is similar in concept to being denied an opportunity to have a lawyer.

Your 'due process rights' were violated and the judgment can be set aside for a new trial. This is done by motion on notice. It is a relatively simple motion.

You might want to speak to an attorney - the DA's case might not have been as strong as you, an amateur, might have thought. You might have a good defense.

You are welcome to a consultation for no fee at my offices at 42 West 44th Street, NY,NY. Please call for an appointment first. (646)591-5786 or (718) 729-2029
