Legal Question in Traffic Law in New York

I was involved in an accident while riding in my sons truck. A tractor-trailer milk truck had blocked both lanes and shoulders at a farm whose driveway is on a blind grade. There is a truck entrance sign posted, but that does not prepare a driver for the sight of a huge stainless steel tank blocking the entire roadway. We chose to hit the ditch, resulting in no injuries, but $7,000.00 in damage to my sons truck. Because we chose to avoid hitting the truck that caused this accident, the trooper on the scene said the milk truck was not involved. We are now screwed, as the trucker says he is not liable for anything, even though he blocked the road, on a blind grade This has happened to other drivers at the same location, same trucking company. Do I have any recourse?
