Legal Question in Traffic Law in New York

I used to have a NY license 5 years ago. I did not know I still had a summons for driving without insurance. I transferred out of state to a Georgia License and drive with Georgia plates. Recently on a trip to NY, I was pulled over for slightly dark window tints. When the cops came back I was arrested for the outstanding insurance issue back when I used to have a NY license. Is this legal, being that I have a valid GA license with GA plates on my car driving through NY? Please help as I stayed in jail for 2 hours because of this and received a desk appearance ticket to see the judge. thanks.

Yes, its legal. The summons has nothing to do with your Georgia license; the summons was issued because you were accussed of driving in NY without proof of insurance before you moved to Georgia. You should get a criminal defense attorney to represent you. I am a former prosecutor and now handle these cases so please feel free to contact me.

The Geogia license has no bearing on the NY criminal violation. You should resolve the insurance lapse problem before going to court. That being said I am a former Traffic Court Judge and I now practice Criminal Defense. If you resolve the insurance lapse. I can usually resolve the criminal charges without both jail time and/or a misdemeanor conviction. Please contact my office @7188340087 for a free phone consultation.
