Speeding ticket in NY

I recently received a speeding ticket in Upstate New York and am planning on fighting the ticket in court. I have never received a ticket before. The officer failed to include the model number of the radar gun used to clock my speed. Will this help in my defense? What can I do to try to avoid the blemish on my driving record?

The police are not required to state the method of their estimation of the speed of the vehicle in question. An officer can testify that he based is charges on his independent estimation of the speed of your vehicle and it is valid under New York State law.

If you go to trial, the officer will usually testify as to which model of laser unit or radar unit they used if they used one.

You can also require service of a supporting deposition on you. If you do not get one in time the case can be dismissed. BTW if you really want your best chance at winning here, you ought to hire a good lawyer for your case. Be sure to check him out on the net thru Findlaw and such and then interview him.
