Legal Question in Traffic Law in New York

wreckless driving

hello,

i was arrested and had to spend a nite in jail in suffolk cty new york. police officer said i was driving wreckless because i went through a police barricade nearly hitting some people.

But what i say is that there was no barricade. there were 2 cones, 20 feet apart covering my lane. if something is that wide open, wouldnt you drive through. I thought my side was open because there was such a big space.

but they arrested me, took my license and took a blood test to test for drugs. that is false, drugs will not be found.

can u tell me what will happen????????/ will i get my license back? please i need help.

people that were dwi, have their license and i dont, plse help me.

Re: wreckless driving

The situation you are in is a very serious one. A reckless driving charge is an unspecified misdemenaor under the vehicle and traffic laws. Your license was taken but should be returned to you in court. Your court date should be very soon, if you were not already arraigned. As for what will happen depends on your past driving and criminal record, what the district attorney's office offers and what your attorney can work out as a plea bargain or if you so decide how a trial is conducted. You should speak to an attorney as soon as possible to get your facts straight and determine what is the best way to proceed.

Re: wreckless driving

From your writing I really can't properly evaluate the situation. Were you arrested ,were you arraigned?Where? Were you represented at arraignment?Reckless driving is a misdemeanor, which carries possible but not likely jail, it also gives you 5 points on your driving record.I think you received a summons, this can be handled with great success through a plea bargain if the summons or appearance ticket is returnable in criminal or district court. You may call my office @7188340087 for a free phone consultation. With more information I can offer better advice.
