Legal Question in Wills and Trusts in New York

Hello my dad and aunt inherited a house (which was to be shared half and half) that was left to them by my grandmother when she had died.. THE DEED WAS TRANSEFERED OVER TO BOTH MY DAD AND AUNT..IT IS IN BOTH THEIR NAMES...my dad has since passed away 6 years ago...where and how in Trinidad can i go about getting a copy of the deed of the house and do my sisters and i (who live abroad) has any rights to my fathers share of the house.

Why did you wait so long after your dad died to raise this issue?

Search the internet and find a lawyer in the area where the house is located and the lawyer will be able to help you. Whether or not you or your sisters have rights to the property depends on the law in Trinidad, not New York.

The property being located in NY, NY law will apply as to the transfer of the property if your dad died without a will. If he died with a will the property will transfer pursuant to the terms of the will. In any event a probate action must be commenced and a partition action undertaken to force the sale of the home, or to force your aunt to pay you and your siblings 50% of the home.
