Legal Question in Wills and Trusts in New York

daughter from deceased who had pension

My daughters father died 17 years ago, we were not together and he never supported her but i recently found out her step brother came into town to claim his pension from construction job. How do I find out if my daughter is entitled to these benefits. The half brother is telling them there were no other siblings so he could get all the money. Does it matter if my daughter was not the beneficiary/ I will be more then willing to submit to dna test with the half brother to show that they are brother ans sister. What should I do?

Re: daughter from deceased who had pension

I would contact the pension fund and find out if the father had a beneficiary listed. If he did not than your daughter may have a claim. Seventeen years is a long time to wait. You have to start somewhere, and the place to start is with the pension fund.

If you need any more help, feel free to contact me.
