death of brother/no will

my brother died and had no will. My father is still alive, but the brother has a son( 7 years old), and is legally divoce. Who would the state award as executor to his estate?

The closest living, adult, relative which seems to be your father. His estate will probably all go to his son, so anticipate that the mother will get involved, as legal guardian for a minor child. It is possible that the estate will ultimately be handled by the Court until the son becomes an adult.
